Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SiteExpensify and its services (“Service”) provided by SiteExpensify. By accessing or using the Service, you agree to be bound by these Terms.

To access and use the Service, you must create a verified account. When registering and operating an account:

• You must create an account to access and use the Service.
• You are responsible for maintaining the confidentiality of your account information, passwords, and multi-factor authentication devices.
• You agree to be held responsible for any and all activities or actions that occur under your account credentials.
• You must immediately notify SiteExpensify upon suspecting any unauthorized breach or loss of account control.

Your license to use the Service is contingent on compliance with acceptable use standards:

• You may use the Service only for lawful purposes and in accordance with these Terms.
• You shall not engage in any activity that disrupts, degrades, or interferes with the functioning of the Service or its users.
• You are solely responsible for the content, invoices, vendor entries, and site receipts you upload, share, or transmit through the Service, and you agree not to post any harmful, offensive, or illegal content.
• Reverse engineering, scraping, or attempting to extract proprietary algorithms or source code from SiteExpensify is strictly prohibited.

The Service and its content, including but not limited to text, graphics, logos, user interfaces, documentation, visual design systems, and software code, are protected by intellectual property laws and are the exclusive property of SiteExpensify or its licensors.

You are granted a limited, non-exclusive, revocable, and non-transferable license to use the Service strictly for its intended purpose of managing construction operations and expense ledgers during the term of your active subscription.

Our Privacy Policy explains how we collect, use, and disclose information about you and is expressly incorporated into these Terms.

By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. SiteExpensify does not warrant that the Service will be uninterrupted, error-free, immune from external vulnerabilities, or that all site defects will be instantaneously resolved.

SiteExpensify shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use or inability to use the Service.

We shall not be responsible for any loss, damage, or injury resulting from unauthorized access to or alteration of your data, network downtime, or commercial construction delays.

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms or non-payment of subscription dues.

Upon termination, all provisions of these Terms that by their nature should survive will continue to apply, including intellectual property clauses, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SiteExpensify operates (Chennai, Tamil Nadu, India), without regard to its conflict of law provisions.

Any dispute or claim arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Chennai, India.

We reserve the right to modify or update these Terms at any time without prior notice. Your continued use of the Service after any modifications shall constitute your acceptance of the revised Terms.

To access and utilize SiteExpensify, users must select an appropriate subscription plan from the options listed on SiteExpensify’s pricing page and agree to pay the corresponding Subscription Fee.

• Annual Payment Schedule: The Subscription Fee can be paid on an annual basis, with payment due within seven (7) days from the date of the invoice.
• Automatic Renewal: Your subscription to SiteExpensify Services will automatically renew unless you terminate your account or provide written notice of non-renewal at least thirty (30) days before the expiration of the current subscription term.
• Plan Updates: Please be aware that the subscription plan you select may be subject to updates from time to time, and it is our responsibility to notify you of such changes.
• Non-Cancelable Commitments: Payment obligations are non-cancelable, and Subscription Fees paid are non-refundable, except as expressly permitted in these Terms of Use and our Cancellation Policy.

The Subscription Fee does not cover any taxes, levies, duties, or similar governmental assessments, including value-added (VAT), sales, use, Goods and Services Tax (GST), or withholding taxes that may be imposed by local, state, provincial, or foreign jurisdictions (collectively referred to as “Taxes”).

You agree to pay the applicable direct or indirect Taxes associated with your purchases under this agreement. If we are legally required to collect these Taxes, they will be itemized on your invoice.

You have the flexibility to upgrade between Subscription Plans as your construction projects scale. We shall not be held liable for any feature or capacity loss resulting from an upgrade.

• Immediate Effect: When you upgrade, the new Subscription Fees will apply immediately.
• Prorated Calculation: Upon upgrading, the new Subscription Fees for the ongoing month/year will be prorated and must be paid in accordance with the terms outlined in these Terms of Use.
• Subsequent Billing Cycles: The subsequent year will be charged at the full rate of the new Subscription Fees, with appropriate adjustments made for any existing account credits.

Payments for subscriptions purchased under the Subscription Plans are refundable strictly as per our designated Cancellation & Refunds Policy.
